WCM LEGAL :
Family matters
Domestic disputes are particularly distressing for the whole family. Sadly, cases of domestic violence, difficult marriage break-ups and disputes over children and property, can frequently only be resolved through resort to the Courts.
Solutions to these problems vary depending on the circumstances. All assaults and threats of violence are crimes, and Police can charge offenders in the District Court. Legal protection can be sought under the Domestic Violence Act and protection orders can be made. There are also other types of orders to help people in violent relationships.
A significant amount of our work in this area is Court-appointed,
where our first role is to fully investigate all the circumstances,
then report back to the Court with recommendations. Our partner
Keith McClure,
Associate Kathryn
Hayman, and staff solicitor Virginia
Pearson all specialise in family law. Both Keith and Kathryn
are on the panel of Counsel for the Child lawyers at the Masterton
District Court. If things such as guardianship disputes cannot
be settled by mediation then we have to resort to a Court decision.
Sometimes marriages have to be dissolved. We can arrange conciliation, protect our client’s rights to matrimonial property and advise about any welfare benefits to which parties are entitled. We have dealt with many personal, family business and property affairs and transactions.
We accept legal aid cases subject to the usual criteria laid down by the Legal Services Agency.
